Introduction

This Privacy Policy (“Policy”) is issued by Dygo Diagnostics Pvt. Ltd. (“Company”, “Dygo”, “we”, “us”, or “our”) and constitutes a legally binding agreement between the Company and all users (“User”, “you”, “your”) accessing or utilizing the Dygo mobile application and/or website (collectively, the “Website”). By registering with or accessing the Website, the User expressly consents to be bound by this Policy, as amended from time to time.

Dygo Diagnostics Pvt. Ltd. is fully committed to the lawful, secure, and prudent treatment of all personally identifiable information, including sensitive personal data (“Personal Information”), collected in connection with your use of our services. The Company adheres strictly to the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“Data Protection Laws”).

If you do not concur with the provisions herein, you are required to cease all usage and refrain from completing the registration procedure on the Website.

Policy Scope and Applicability

This Policy comprehensively governs the collection, storage, processing, usage, disclosure, and protection of Personal Information by Dygo Diagnostics Pvt. Ltd. during its operations. All Users are deemed to have accepted the entirety of this Policy from the moment they access or use the Website.

The Website may contain links or integrations to third-party sites, platforms, or social media services that are outside the control of Dygo Diagnostics Pvt. Ltd. This Policy shall not extend to, nor impose obligations upon, such third-party entities, each of which may operate under independent privacy policies and practices. The Company expressly disclaims any liability or responsibility for the privacy standards or content of external websites.

No summary, paraphrase, or third-party-generated interpretation of this Policy shall possess legal force or alter the intent or effect of this Policy.

Acquisition and Handling of Personal Information

Dygo Diagnostics Pvt. Ltd. collects Personal Information that you voluntarily provide during account creation and use of Website services, including, but not limited to:

  • Name, contact details, age, date of birth
  • Medical and prescription information, medical status, records history, medication history
  • Account credentials, device data, geolocation, and images

In addition, the Website and authorized third-party providers may collect anonymized information through cookies, pixel tags, server logs, and similar technologies, including technical device identifiers, access logs, operating system details, device preferences and configurations, and usage analytics. Such information shall be used strictly for authentication, personalization, enhancing user experience, security, and statistical analysis.

Users retain full control over their cookie preferences; however, refusal to accept cookies may compromise Website functionality.

Providers of advertising or analytics services integrated with the Website may deploy cookies or similar technology to measure advertising efficacy and improve relevance, subject to applicable legal constraints.

The Company also records device IP addresses exclusively for administration, audit, and enhancement of Website security protocols.

Payment Information Protocol

Dygo Diagnostics Pvt. Ltd. neither accesses nor retains payment information of Users. All financial transactions are conducted over secure, third-party gateway facilities beyond the control or purview of the Company. Dygo expressly disclaims all liability for any loss, unauthorized access or disclosure of payment data arising from use of external payment gateways, including transactions involving credit/debit cards, mobile wallets, UPI, or equivalent modalities.

Under no circumstances shall Dygo Diagnostics Pvt. Ltd. be liable for any direct, indirect, consequential, or punitive damages arising from the disclosure or misuse of payment-related information.

Utilization and Disclosure of Personal Information

Personal Information provided by Users is processed exclusively to facilitate service provisioning as requested by the User.

By accepting this Policy and the Terms & Conditions of Website use, each User expressly authorizes Dygo Diagnostics Pvt. Ltd. to communicate product updates, service offerings, targeted advertisements, newsletters, and operational notices via electronic communication channels. Users retain the right to withdraw consent for such communications at any time, in accordance with prescribed procedures.

The Company shall not disclose Personal Information to any entity, except with explicit User consent or pursuant to mandatory requirements under applicable law, governmental order, or regulatory authority.

Dygo may, without disclosing individual identities, share aggregated, anonymized user data with trusted partners, clients, or service providers for analytical and operational purposes. In the event of business transfer, acquisition, merger, or sale of substantial assets, all Personal Information may be lawfully transferred to the acquiring party, whose privacy policy shall thereafter apply.

Security Assurance

Dygo Diagnostics Pvt. Ltd. shall, at all times, implement robust, state-of-the-art security infrastructure and protocols, in full compliance with prevailing Data Protection Laws, to prevent unauthorized access, modification, destruction, or disclosure of Personal Information.

All data transmissions are encrypted and stored on secure servers protected by advanced, continuously-updated anti-malware solutions and physical access restrictions. The User is solely responsible for maintaining the confidentiality and security of account credentials and personal devices. Dygo expressly disclaims liability for breaches arising from User negligence.

Users are cautioned against falling victim to phishing schemes, impersonation attempts, or fraudulent communications purporting to originate from Dygo Diagnostics Pvt. Ltd. Any suspicious correspondence must be immediately reported to our Grievance Officer.

The Company categorically does not sell, lease, license, lend, trade, or rent any Personal Information belonging to Users.

Access, Correction, and Retention of Data

Users may submit formal written requests to Dygo’s designated Grievance Officer to access, correct, or update Personal Information maintained by the Company. Identity verification may be mandated prior to processing such requests to uphold data protection standards.

Personal Information shall be retained solely for the duration required to fulfil legitimate business purposes or as mandated by law; retention beyond these limits is impermissible.

Conduct and Restrictions

As required under Regulation 3(2) of the Information Technology (Intermediary Guidelines) Rules, Users are expressly prohibited from using the Website to:

  • Upload, publish, or transmit data belonging to third parties without right or legal entitlement
  • Disseminate content that is harmful, defamatory, obscene, infringing, or otherwise unlawful
  • Harm minors or facilitate abuse
  • Infringe upon patents, copyrights, trademarks, or proprietary rights
  • Violate applicable statutes or governmental regulations
  • Misrepresent or disguise message origin
  • Impersonate others
  • Incorporate viruses, malicious code, or harmful programs
  • Threaten the security, unity, sovereignty of India, foreign relations, public order, or incite commission of offenses
  • Promote illegal consumption of regulated substances

Further, Users shall not:

  • Attempt or effect unauthorized access or disruption of Website security
  • Upload or transmit competitive or disruptive content
  • Provide false or misleading information
  • Send unsolicited communications to other Users
  • Use automated agents (e.g., spiders, bots) for navigation or scraping
  • Attempt to reverse-engineer Website software
  • Duplicate, frame, or deep-link Website content
  • Post fraudulent or infringing material on any Company-affiliated social media platform

Policy Amendments

Dygo Diagnostics Pvt. Ltd. may, at its sole discretion and without prior notice, amend, modify, or update this Policy to reflect evolving legal, technological, or business requirements. Amendments become effective immediately upon publication on the Website. Continued usage post-amendment signifies binding acceptance of the revised Policy.

Governing Law and Dispute Resolution

This Privacy Policy and all associated documentation shall be governed by, and construed in accordance with, the laws of India. Disputes shall be subject to binding arbitration under a sole, independent arbitrator (retired judge/judicial officer) nominated by the Company, in accordance with the Arbitration and Conciliation Act, 1996 as amended, to be conducted in New Delhi, in the English language. Courts located at New Delhi shall possess exclusive jurisdiction for interim relief or injunctions.

Physical and electronic copies of this Policy and any related notice shall be admissible in judicial or administrative proceedings to the same extent as business records maintained in printed form.
