1. Introduction and Acceptance

Welcome to Dygo Diagnostics Pvt. Ltd. (hereinafter referred to as “Dygo”, “the Company”, “we”, “us” or “our”) and the online platform accessible via [www.dygodiagnostics.com] and/or through designated mobile applications, owned and operated by Dygo Diagnostics Pvt. Ltd. (collectively, the “Platform”). The content, services, and all other functionalities offered on the Platform are proprietary to Dygo Diagnostics Pvt. By accessing or utilizing the Platform, the User (“User”, “you”, “your”) acknowledges and represents to have read, understood, and agreed to be legally bound by these Terms of Use, all supplemental policies, guidelines and any referenced or incorporated documents, including the Privacy Policy (together, the “Agreement” or “Terms”).

2. Eligibility

By accessing or utilizing the Platform and Services, Users affirm, represent, and warrant that:

  • They are at least eighteen (18) years of age or possess legal capacity under applicable law to enter into a binding contract in their jurisdiction.
  • They shall be solely responsible for any and all transactions and actions made under their name or via their account.
  • They shall utilize the Platform in strict compliance with all applicable laws, rules, and regulations at all times.

3. Definition and Scope of Services

Dygo, through its Platform, offers the following services (“Services”), which may include, but are not limited to:

  • Diagnostic and wellness investigations/health test services (including home sample collection)
  • Diagnostic investigations/health scans at designated laboratories or test centers
  • Radiology services
  • Medical practitioner consultations (including but not limited to telemedicine)
  • Any ancillary services as Dygo may introduce from time to time in its exclusive discretion

The Company reserves the right to amend, suspend or discontinue any of these Services, or to revise applicable prices and/or deliverables, with or without advance notice.

4. Diagnostic and Other Services

4.1 Diagnostic & Radiology Services:

  • Users may book health investigations, diagnostic tests, and radiology scans (“E-Health Packages”) online, either for home collection or at selected collection centers, subject to service availability and platform guidelines.
  • Dygo or its representatives will confirm bookings via digital communications.
  • Reports will be provided within timelines stipulated during booking, subject to exceptional delays caused by unforeseen events.
  • Diagnostic Services are strictly non-transferable; only the individual in whose name the booking is made may avail the corresponding Services.
  • Users are required to adhere to all preparatory instructions and disclaimers issued by Dygo; diagnostic reports are not a substitute for physician’s advice and must be corroborated accordingly.

5. Payments

  • Dygo provides payment facilities via authorized third-party payment gateways. Services commence only post receipt of consideration due.
  • Payments may be subject to additional third-party terms; Users are responsible for familiarizing themselves with such terms before making payments.
  • The Company reserves unilateral right to cancel or refuse any order or Service for which payment is incomplete, delayed, or disputed; refund, if any, shall be processed in accordance with Dygo’s refund protocols and credited within stipulated timelines, subject to applicable deductions.
  • All taxes, levies, and statutory charges are borne solely by the User.

6. Personal Information

The collection, use and disclosure of Personal Information is governed exclusively by the Dygo Privacy Policy, which forms an integral part of these Terms. Users may, subject to prescribed procedures, withdraw consent for the use of personal data; however, such withdrawal may render the User ineligible for continued access or use of the Platform or Services.

Data Sharing and Report Retrieval Consent: The User hereby acknowledges and expressly consents that, in order to facilitate the provision of services requested through the Platform, Dygo Diagnostics Pvt. Ltd. is authorized to share the User’s personal information, medical data, and other relevant details with the designated Service Providers. The User further consents to the retrieval and collection of test reports, results, and communications from such Service Providers on their behalf, for the sole purpose of service delivery via the Platform. Dygo shall ensure such disclosures and retrievals are strictly limited to what is necessary for performance of services, and subject to applicable legal and privacy obligations. The User agrees and understands that their information may be processed and stored by Service Providers who are independently responsible for compliance with all applicable laws and standards governing the handling of sensitive medical and personal data.

7. Cancellation, Refunds and Rescheduling

  • Dygo reserves complete discretion to reschedule or cancel appointments or bookings with prior notification to Users; delays may occur on account of events outside Dygo’s control (including force majeure).
  • Users may reschedule or cancel bookings via the options and procedures that Dygo expressly provides on the Platform, subject to applicable policies and charges.
  • Refund requests must be supported by requisite documentation and are processed at Dygo’s discretion, in accordance with Company policy.

8. Limitation of Liability

  • All services and content provided via the Platform are offered strictly on an “as is” and “as available” basis. To the fullest extent permitted by law, Dygo disclaims all warranties, express or implied, including but not limited to the accuracy, fitness for purpose, merchantability, or non-infringement of the services or content provided.
  • The User’s sole remedy for dissatisfaction with the Platform or Services is to discontinue use.
  • In no event shall Dygo or its affiliates be liable for any direct, indirect, incidental, consequential, exemplary, or punitive damages, loss of data, loss of profits, or other losses arising directly or indirectly from use of the Platform or Services, even if advised of the possibility thereof.
  • Aggregate liability, if any, is limited strictly to the amount paid by the User toward the availed Service giving rise to such claim.
Aggregator Disclaimer; Limitation of Liability
  • The User expressly acknowledges and agrees that Dygo Diagnostics Pvt. Ltd. acts solely as an aggregator and facilitator of diagnostic, healthcare, and related services, and does not render, control, supervise, or guarantee the quality or outcomes of services directly.
  • All diagnostic, consultation, and healthcare services accessed through the Platform are provided exclusively by independent third-party service providers (“Service Providers”).
  • Dygo assumes no liability or responsibility for any act, omission, default, deficiency, error, conduct, or negligence of any Service Provider and shall not be liable for any complaint, dispute, claim, injury, loss, or damage arising out of or in relation to services rendered by Service Providers.
  • The User’s sole recourse in respect of any dissatisfaction, dispute, negligence, or deficiency in the provision of healthcare or diagnostic services shall be against the relevant Service Provider, and the User agrees to address all such complaints directly with the relevant Service Provider.

9. Medical Disclaimer

The Platform is not intended to provide, nor should any Service or Content provided be construed as providing, professional medical advice, diagnosis, or treatment. No doctor-patient relationship is created by use of the Platform. Users must seek professional clinical advice for all medical needs and are expressly dissuaded from reliance on Platform Content as a substitute for medical evaluation or emergency intervention.

10. Indemnification

Users undertake to indemnify, defend, and hold harmless Dygo, its subsidiaries, affiliates, officers, directors, agents, and employees from any claims, damages, losses, liabilities, costs, or expenses arising from or related to violations of these Terms, use of the Platform, or infringement of any laws or third-party rights by the User.

11. Intellectual Property

All intellectual property, including but not limited to trademarks, content, software, designs, logos, and database rights are the exclusive property of Dygo or its licensors. Users are strictly prohibited from copying, modifying, distributing, or using any content or material for commercial purposes without Dygo’s express written consent.

12. Miscellaneous

12.1 Governing Law and Dispute Resolution:These Terms are governed by the laws of India. All disputes arising hereunder shall be exclusively subject to arbitration by a sole arbitrator appointed by Dygo, to be conducted in New Delhi, in English, as per the Arbitration and Conciliation Act, 1996 (as amended). Subject to arbitration, courts in New Delhi shall have exclusive jurisdiction.

12.2 Force Majeure:Dygo shall not be liable for failure or delay in performing its obligations where such failure arises from circumstances beyond reasonable control, including but not limited to, natural disasters, government orders, strikes, pandemics, civil disturbances, wars, or technological failures.

12.3 Severability: If any provision in these Terms is determined to be unlawful or unenforceable by a competent authority, such provision shall be severed without affecting the validity of the remaining provisions.

12.4 Assignment:Dygo may freely assign or transfer its rights and obligations under these Terms without notice. Users may not assign any rights or delegate any obligations hereunder without Dygo’s prior written approval.

12.5 Waiver: No waiver of any provision or breach shall be deemed to be a waiver of any other provision or subsequent breach.

13. Grievance Redressal

Users may address all complaints, feedback, or grievances to the Grievance Officer designated by Dygo, whose name and contact details are accessible on the Platform and as updated from time to time.
